Terms of Service

Who we are

WorksHub is a recruitment marketplace operated by Functional Works LTD ("WorksHub", "we", "us"). We run a job board and a referral bounty network across our specialist tech communities — AI Works, Blockchain Works, Functional Works, Remote Works and JavaScript Works — all on one shared platform.

These terms form a contract between you and WorksHub covering your use of the website, your account and any paid service you buy from us. By creating an account, posting a listing, applying to a role or submitting a referral, you accept them.

Account types

Different sections apply depending on how you use WorksHub. Section 3 applies to hiring companies and recruitment agencies. Section 4 applies to candidates. Section 5 applies to referrers. Sections 1, 2 and 6 onwards apply to everyone. One person or organisation can hold more than one role — for example, a recruiter who also refers candidates — in which case every relevant section applies.

Changes

We may update these terms as the platform develops. Material changes will be notified by email or in-product at least 14 days before they take effect. Continued use after that point is acceptance. Changes never apply retrospectively to a bounty already claimed, a listing already paid for, or a hire already made.

Registration

• You must be at least 18 and have the authority to accept these terms for yourself or the organisation you represent.
• Account details must be accurate and kept up to date. You are responsible for everything done under your login.
• One account per person. Employer workspaces may have multiple named team members, each with their own login.
• Accounts created by import or claimed by magic link are subject to these terms from the moment they are first accessed.

What you must not do

• Post a role that does not exist, is already filled, or is used primarily to harvest CVs.
• Post discriminatory requirements, unpaid work presented as employment, or anything unlawful in the jurisdiction of the role.
• Scrape, resell or redistribute candidate data, job listings or platform content.
• Submit a candidate's details as a referral without that candidate's knowledge and consent.
• Misrepresent who you are, who you work for, or your relationship to a candidate or client.
• Attempt to move a WorksHub-sourced candidate or referral off-platform to avoid a fee or bounty.

Suspension

We may suspend or close an account that breaches these terms. Where a breach is deliberate — a fabricated referral, a circumvented bounty, a fake listing — we may withhold pending payouts and recover amounts already paid. We will always tell you why and give you a chance to respond, except where the law prevents it.

Listings

• There are two commercial routes: a self-serve job listing, or full-service recruitment. A standard job listing is £200 excluding VAT and runs for 60 days across the main board plus one community.
• Full-service recruitment, where we source, screen and shortlist for you, is charged at 20–25% of the hire's first-year salary and invoiced 30 days after their start date. Listing fees are not payable on roles run this way.
• Candidate recommendations and search is an optional add-on to a standard listing at £300 excluding VAT per listing.
• Listing fees are charged immediately at checkout when you publish. There is no free trial, grace period or fair-billing window.
• You are responsible for the accuracy and legality of everything in your listing, including salary, location and right-to-work requirements.
• Confidential mode masks your name or your client's name on public listings. It does not prevent a candidate from identifying the employer once you disclose it to them.

Referral bounties

• A referral bounty is an amount you commit to pay if a referred candidate is hired. You set it when you post: direct employers typically use 5–20% of first-year salary; agencies posting inter-agency bounties typically use a £500–£1,000 flat fee.
• The bounty is split between the referrer and the hired candidate at the percentage shown on the listing. WorksHub retains 15% of the bounty on payout.
• One reward is payable per hire. Where a candidate arrives with both a signing bonus and a referral bounty attached to the role, both may be payable only if the listing says so explicitly.
• You are invoiced on the hire's start date, payable net 30. Referrer and candidate are paid on day 60.
• You may cancel a bounty at any time up to day 60 and receive a full refund if the hire does not start or does not stay — see section 6.

Signing bonuses (agencies)

• A signing bonus is an amount an agency commits to pay directly to the hired candidate. It is not a referral reward and is payable whether or not a referrer was involved.
• The bonus is stated on the listing and forms a commitment from the agency to the candidate. WorksHub administers the payment but is not the paying party.
• Signing bonuses are available to recruitment agencies only, alone or alongside a referral bounty.

Candidate data

• Candidate details, CVs and recommendations are provided for the purpose of assessing candidates for the roles you have posted. Nothing else.
• You must not share candidate data with third parties, add candidates to marketing lists, or retain data longer than you need it for the role.
• You act as an independent data controller for candidate data you receive. You are responsible for your own compliance with applicable data protection law.

No exclusivity

WorksHub does not require exclusivity, retainers or minimum commitments. You are free to source candidates through any other channel at the same time. Equally, we do not guarantee any number of applications, referrals or hires.

Free to use

WorksHub is and will remain free for candidates. We never charge you to apply, to be referred, or to receive a payout.

Your profile

• You confirm the information in your profile and CV is true and yours to share.
• Applying to a role shares your profile, CV and selected skills with that employer. We tell you who before you apply, except where the employer has posted confidentially.
• You can update, download or delete your profile at any time from your dashboard. Deleting it does not withdraw applications already sent.
• If your profile was created from an import, it stays hidden from employers until you claim it and confirm these terms.

Being referred

• Nobody can refer you without your confirmation. A referral only becomes active once you approve it from your dashboard.
• You may decline a referral, or approve a different referrer, at any time before an employer progresses you.
• Where a referral bounty applies and you are hired, your share of the bounty is paid to you on day 60 after your start date, subject to you still being in the role.

Signing bonuses paid to you

• Some listings carry a signing bonus: a cash amount paid directly to you if you are hired into that role. The amount and currency are shown on the listing before you apply.
• A signing bonus shown on a listing is a commitment from the posting company or agency, not from WorksHub or, where different, the end employer. WorksHub administers the payment but is not the paying party.
• You are eligible if you were hired into the role the bonus was attached to, whether you applied directly or were referred. A signing bonus is separate from any referral bounty — where a listing carries both, you receive your signing bonus in full and, if you were referred, your referrer receives their share of the bounty.
• It is payable on day 60 after your start date, subject to you still being in the role on that date, and is paid gross via the payment details you give us in your dashboard.
• The bonus stated on the listing when you applied is the amount that stands. It cannot be reduced or withdrawn after you accept the offer.
• If you do not start, or leave or are terminated before day 60, no signing bonus is payable.
• Signing bonuses and referral payouts are income. You are responsible for declaring them and for any tax due — see section 6.
• If a bonus is not paid within 14 days of falling due, contact us and we will pursue it with the posting company on your behalf.

Who can refer

Anyone with a WorksHub account can refer: a friend, a former colleague, a community member or a professional recruiter. You do not need a contract with the employer, exclusivity, or a recruitment licence. Referrers are not employees, workers or agents of WorksHub or of the employer.

Candidate-confirmed ownership

• Ownership of a referral is decided by the candidate, not by timestamps. When you submit a referral, the candidate is asked to confirm you as their referrer.
• If more than one person refers the same candidate for the same role, the candidate chooses which referral stands. Only the confirmed referrer is paid.
• If the candidate confirms nobody, or had already applied directly before the referral was submitted, no referral bounty is payable.
• You must have the candidate's agreement before submitting them, and you must not refer someone you currently manage.

Getting paid

• You are paid your share of the bounty on day 60 after the candidate's start date, provided the candidate is still in the role.
• WorksHub retains 15% of the bounty on payout. The remainder is split between you and the candidate at the percentage shown on the listing.
• Payouts are made to the details on your account. We may ask you to verify your identity before releasing a payment.
• If a hire is reversed, withdrawn or refunded before day 60, no payout is due. Amounts already paid in error are recoverable.

Billing

• Listing fees are charged by card immediately at checkout when the listing is published. A VAT invoice is emailed automatically.
• Bounties and signing bonuses are invoiced separately on the hire's start date, payable net 30.
• Prices are exclusive of tax unless stated otherwise. Where you are billed in GBP, UK VAT is applied at the prevailing rate where chargeable. Where you are billed in US dollars, no UK VAT is charged; any local sales tax is calculated at checkout from your billing address.
• Late payment may attract statutory interest and suspension of active listings.

Refunds

• A bounty is fully refundable at any time up to day 60 after the hire's start date — if the hire does not start, leaves, or is terminated, you pay nothing.
• Because payouts are made on day 60, a refund before that date means no money has left the platform.
• Listing fees are non-refundable once the ad has gone live, unless we fail to publish it.

Tax and invoicing

WorksHub does not deduct tax from payouts. Referrers and candidates receive gross amounts and are solely responsible for declaring them to their tax authority and paying any income tax, national insurance or equivalent that is due.

Referrers acting in the course of a business, including recruitment agencies, must invoice WorksHub for their payout and account for VAT where they are registered. We will provide a self-billing statement on request.

Nothing in these terms creates an employment, agency or partnership relationship between WorksHub and a referrer or candidate.

How we handle data

We collect and process the account, profile, CV, application and referral data needed to run the marketplace. What we collect and why is described in our privacy notice, which forms part of these terms.

We use your data to match you to roles, to surface candidate recommendations to employers who have paid for them, and to operate payouts. We do not sell personal data.

Your rights

• You can access, correct, export or delete your personal data from your dashboard, or by contacting us.
• Candidate profiles created from imports are hidden until claimed, and can be deleted on request without ever being claimed.
• We keep application and referral records for as long as needed to administer a hire and any resulting payout, and to meet our legal and accounting obligations.

What we are and are not responsible for

WorksHub is a marketplace. We are not the employer, we are not a party to any employment contract, and we do not guarantee the accuracy of listings or profiles, the conduct of employers, agencies, referrers or candidates, or that any application will lead to an interview or a hire.

We provide the platform on an as-is basis and do not warrant uninterrupted availability. We will, however, act in good faith to keep it running and to resolve problems quickly.

Limits

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability to you for any claim is capped at the greater of the fees you paid us in the 12 months before the claim, or £500.

We are not liable for indirect or consequential loss, loss of profit, loss of business opportunity, or the cost of a replacement hire.

Disputes

Disputes about referral ownership are resolved by the candidate's confirmation, which is final. Disputes about a hire, a bounty or an invoice should be raised with us within 30 days; we will investigate and respond within 14 days.

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
